This Chargeback Prevention and Refund Policy establishes the rights, responsibilities, and obligations of both parties in transactions conducted with NEXTIFY MARKETS LTD. It integrates our chargeback prevention measures and refund policy to ensure a secure, transparent, and fair trading environment for cryptocurrency transactions.

By initiating a transaction with NEXTIFY MARKETS LTD (Company Number: 16063228, Registered Office: 167 - 169 Great Portland Street, 5th Floor, London, England, W1W 5PF), you explicitly acknowledge and agree to abide by the terms outlined in this policy. This includes adherence to our refund policy and compliance with the procedures outlined for chargeback prevention.

Failure to comply with the terms of this policy may result in the denial of refunds, the termination of services, and/or further legal action as outlined in subsequent sections. This document is a binding agreement between you as the buyer and NEXTIFY MARKETS LTD, ensuring accountability and a smooth transaction experience for all parties involved.

2. Definition of a Chargeback
A chargeback occurs when a payer disputes a transaction and requests their financial institution to reverse the payment. For the purposes of this policy:
  • The payer is the individual purchasing cryptocurrency through our platform.
  • The payer must ensure that all payment details, KYC information, and agreements match the information provided during the trade process.
3. Accepted Payment Methods
We accept the following payment methods for cryptocurrency transactions including but not limited to the list below:
  1. Bank transfers.
  2. Credit and debit cards.
  3. Secure payment links and other approved methods.

4. Customer Verification (KYC)
To prevent fraudulent activity, we require all customers to complete the following KYC process before initiating a transaction:
  1. Submission of a government-issued ID scan.
  2. Proof of address (not older than 3 months).
  3. A selfie with the ID and the current date.
The payer’s payment details must match the information provided during the KYC process and in the transaction agreement. Failure to meet this requirement may result in the transaction being voided and subject to refund processing fees (see below).

5. Prohibition of Joint Accounts. Individual or Verified Business Account Use Only
To ensure the integrity and security of all transactions, NEXTIFY MARKETS LTD strictly prohibits the use of joint personal accounts for making payments. Payments must originate from:
  • Accounts held solely in the name of the payer whose identity has been verified through the KYC process, or
  • Verified business accounts authorized and approved through the business KYC verification process.
Payments from unauthorized accounts, including joint personal accounts, are not permitted.

6. Consequences of Using Unauthorized Accounts
In the event that a joint personal account or other unauthorized account is used:
  • The transaction will be automatically canceled.
  • The amount paid will be refunded, subject to a 15% processing fee to cover administrative and compliance costs.
  • The payer may be required to provide additional verification documentation to process the refund.

7. Breach of Agreement
The use of unauthorized accounts, including joint personal accounts, constitutes a violation of this policy and is considered a breach of the agreement between the payer and NEXTIFY MARKETS LTD. This breach may result in the following actions:
  • Cancellation of any pending or future transactions.
  • Reporting of the incident to relevant authorities if necessary.

8. Responsibility of the Payer or Business
It is the responsibility of the payer or business to ensure that all payment accounts used for transactions:
  • Are registered in the name of the individual or entity whose identity has been verified through the KYC process.
  • Comply with the accepted payment methods outlined by NEXTIFY MARKETS LTD.
Failure to meet these requirements may result in administrative actions, including cancellation of the transaction and refunds subject to the applicable processing fee.

9. Chargeback Prevention Measures

9.1. Fraud Detection and Monitoring
  • All transactions are monitored for suspicious activity using advanced fraud detection tools.
  • Payments from third-party accounts are strictly prohibited.
9.2. Communication and Transparency
Customers must contact our support team at support@nextasset.markets before initiating a chargeback to resolve disputes amicably.

9.3. Proof of Delivery
Cryptocurrency delivery is confirmed through transaction logs, screenshots, and platform notifications, which will be used as evidence in case of disputes.

9.4. Chargeback Waiver Clause. By proceeding with a transaction, you explicitly agree:

9.4.1. Obligation to Contact Us First
  • In the event of any issue or dispute related to the transaction, you are required to contact NEXTIFY MARKETS LTD at support@nextasset.markets and make a good-faith effort to resolve the matter directly with us before initiating a chargeback through your financial institution or payment provider.
  • As part of this requirement, you must retain and submit proof of your attempt to contact us, such as:
  • Copies of emails or messages sent to: support@nextasset.markets
  • Any acknowledgment or response received from NEXTIFY MARKETS LTD.
9.4.2. Waiver of Chargeback Rights. You waive your right to initiate a chargeback unless:
  • You have provided NEXTIFY MARKETS LTD with sufficient time and evidence to address your concerns.
  • We have explicitly authorized you in writing to proceed with a chargeback.
9.4.3. Evidence of Breach
  • In the event of an unauthorized chargeback, this clause will serve as evidence of your breach of this agreed policy.
  • NEXTIFY MARKETS LTD reserves the right to present this agreement, proof of cryptocurrency delivery, your KYC compliance, your transaction records, and the absence of any proof of contact attempt as evidence to dispute the claim with your financial institution or payment provider.
9.5. Legal Consequences for Fraudulent Chargebacks

9.5.1. Civil and Criminal Liability
Any chargeback initiated contrary to this policy—particularly without prior communication and proof of contact with NEXTIFY MARKETS LTD—will be classified as a fraudulent chargeback.
Fraudulent chargebacks may result in legal action, including but not limited to filing a civil lawsuit to recover:
  • All losses incurred.
  • Legal fees and associated costs.
  • Business and reputational damages.

9.5.2. Reporting to Authorities
Fraudulent activity may be reported to credit bureaus, financial institutions, and relevant law enforcement agencies.
This can result in:
  • A negative impact on your credit rating for a minimum of seven years.
  • Criminal investigations for fraudulent financial activity.

9.5.3. Requirement to Submit Proof of Contact:
You must provide clear evidence that you attempted to contact NEXTIFY MARKETS LTD prior to initiating a chargeback. Accepted forms of proof include:

  • Screenshots of submitted contact forms or chat messages.
  • Any acknowledgment of receipt from NEXTIFY MARKETS LTD.
Failure to provide such proof will be deemed a violation of this policy.

10. Refund Policy. Refund Eligibility.
Refunds are available under the following circumstances:
  • Overpayments or Errors: Full refunds are issued, subject to a 2% processing fee.
  • Voluntary Cancellation (Mutual Agreement): Full refunds are issued, subject to a 2% processing fee.
  • Not Matching Identity or Third-Party Payments: Refunds are issued, subject to a 15% processing fee.

11. Refund Process
To request a refund:
  1. The buyer must submit a refund request from the email address used during the transaction and send it to this email: support@nextasset.markets.
  2. The buyer must sign a Refund Notice and Agreement, provided by our team.

12. Refund Timeline
Refunds are typically processed within 10 business days, although most are completed on the same day.
